Jack R. Hayes is an associate in the Washington office of Steptoe & Johnson LLP, where he is a member of the International Department.

Mr. Hayes’ areas of practice include US antidumping and countervailing duty law, particularly relating to those rules governing non-market economies, international business regulatory compliance, including export and import regulations, and public international arbitration disputes.

International Law and Trade
Experience includes advising and advocating on behalf of both foreign and domestic clients on international trade matters, specifically focusing on antidumping duty investigations and reviews of Non-Market Economy respondents’ merchandise, such as wooden bedroom furniture and lined notebook paper from China, import classification and valuation, customs protests, substantial transformation issues, compliance with import quotas, and preferential tariff rate requirements.  Work in these subject areas involves advising clients on the requirements and procedures of US trade law; assisting clients on compliance with these laws; responding to US government agency requests for information; and advocating on behalf of clients before the relevant US agencies, including the Departments of Commerce (Import Administration) and Homeland Security (Customs and Border Protection).

International Regulatory Compliance
Experience includes representing foreign and domestic clients on international regulatory matters involving dual use and defense article export, re-export, and deemed export controls, US economic sanctions, anti-money laundering and anti-terrorist financing compliance, anti-boycott compliance, foreign corrupt practices compliance, and sales export declaration reporting requirements.  This work involves counseling clients on how to implement successful company strategies in the context of overlapping international trade law and regulations in these subject areas; providing compliance advice; drafting opinions; conducting internal investigations; and advocating on behalf of clients with the principal US agencies, including the Departments of Commerce (Bureau of Industry and Security), State (Directorate of Defense Trade Controls), and Treasury (Office of Foreign Assets Controls).

Worldwide Arbitration and Dispute Resolution
Experience includes supporting the representation of clients in international arbitration dispute settlement proceedings involving the World Trade Organization, North American Free Trade Agreement, and the International Center for Settlement of Investment Disputes.  Work also has involved counseling clients on public international law, including the UN Convention on the Law of the Sea and UN Convention on the Limits of the Continental Shelf, maritime boundary disputes, international sovereignty disputes to land territory, sovereign immunity, and treaty law.

Before law school, Mr. Hayes worked as a legal assistant where he handled international trade and tax matters involving the jurisdiction of the House Committee on Ways and Means and the Senate Committee on Finance. In that capacity, Mr. Hayes worked extensively on legal issues addressing the United States’ extension of permanent normal trade relations with the People’s Republic of China.
